These Terms of Service ("Terms") govern your use of the ChefPro Appliances website at https://www.chefproappliances.com (the "Site") and any purchases made through the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use our Site.

1. Products and Pricing

All product descriptions, images, specifications, and pricing displayed on the Site are for informational purposes and are subject to change without notice. While we make every effort to ensure accuracy, we do not warrant that product descriptions or pricing are error-free.

We reserve the right to correct any errors in pricing or product information and to cancel any orders placed based on incorrect information, even after your order has been confirmed.

2. Orders and Payment

By placing an order through our Site, you represent that you are at least 18 years old and that all information you provide is accurate and complete.

  • All orders are subject to acceptance and availability.
  • We accept payment via credit card, debit card, and other methods as displayed at checkout.
  • Payment is taken when you place your order. Your card is charged the order total at that time.
  • Prices are quoted in U.S. dollars and do not include applicable taxes, which are calculated at checkout. We do not charge for delivery on online orders.

3. Shipping and Delivery

We ship to addresses within the United States. Estimated delivery times are provided at checkout but are not guaranteed. Delivery dates may vary due to carrier delays, weather, or other factors beyond our control.

Risk of loss and title for items purchased pass to you upon delivery to the carrier. For large or specialty appliances, white-glove delivery options may be available and will be quoted separately.

4. Returns and Refunds

Product returns are subject to our return policy and individual manufacturer policies. To initiate a return, please contact us within 30 days of delivery.

  • Items must be in their original packaging and unused condition.
  • Custom or special-order items may not be eligible for return.
  • Return shipping costs may apply unless the return is due to our error or a defective product.
  • Refunds will be issued to the original payment method within 5–10 business days after we receive the returned item.
  • A 3.5% payment processing fee is applied to refunded orders and is deducted from the amount refunded. Card processing fees charged to us at the time of purchase are not returned to us when an order is refunded, so this fee covers that cost. It is calculated on the original order total.

The 3.5% processing fee does not apply where the return is due to our error, a product that arrives damaged or defective, or an order we are unable to fulfill. In those cases you are refunded in full.

5. Warranty

Products sold through our Site are covered by their respective manufacturer warranties.ChefPro Appliances does not provide any additional warranty beyond the manufacturer's warranty. Please refer to the product documentation or contact us for warranty details on specific products.

6. Intellectual Property

All content on the Site, including text, images, logos, graphics, product descriptions, and software, is the property of ChefPro Appliances or its content suppliers and is protected by U.S. and international copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written permission.

7. User Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any portion of the Site or its systems
  • Interfere with or disrupt the Site's operation or servers
  • Use automated tools to scrape, collect, or harvest data from the Site
  • Submit false or misleading information

8. SMS Communications

If you opt in to receive SMS messages, you agree to receive text messages fromChefPro Appliances regarding your orders and, if separately consented to, promotional offers. 9. Limitation of Liability

To the fullest extent permitted by law, ChefPro Appliances, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site or any products purchased through the Site, including but not limited to loss of revenue, data, or use.

In no event shall our total liability exceed the amount you paid for the specific product or service giving rise to the claim.

10. Disclaimer of Warranties

The Site and all products and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Indemnification

You agree to indemnify, defend, and hold harmless ChefPro Appliances and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising from your use of the Site or violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Fulton County, Georgia.

13. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
